EMPLOI is operated by EMPLOI Group (Pty) Ltd, a company registered in South Africa, together with its US affiliate EMPLOI Inc. Together we act as the Employer of Record for talent hired on behalf of our clients.

For the purposes of GDPR and POPIA, EMPLOI acts as a data controller for information about website visitors, prospective clients, and its own workforce, and as a data processor for information about candidates and employees managed on behalf of a client.

We collect information in three ways:

• Information you give us - name, work email, company, role, and any details you share via forms, demo requests, calculators, or support conversations.
• Information we collect automatically - device and browser type, IP address, pages viewed, and referring URL. We use privacy-respecting analytics and functional cookies to operate the site.
• Information from clients and partners - for candidates and employees, we receive identity, payroll, tax, benefits, and banking details required to run the employment relationship.

We use personal information to:

• Respond to inquiries, book demos, and provide the services you request.
• Operate payroll, benefits, contracts, tax filings, and statutory reporting.
• Improve our website, product, and customer communications.
• Meet legal, regulatory, and audit obligations in South Africa and the US.
• Prevent fraud and protect the security of our systems and users.

We do not sell personal information and we do not use it for advertising to third parties.

Depending on the jurisdiction, we rely on your consent, the performance of a contract, compliance with a legal obligation, or our legitimate interests in running and improving EMPLOI. Where consent is the basis, you can withdraw it at any time.

We share information only with vendors that support our services - for example, payroll infrastructure, benefits providers, cloud hosting, analytics, and email delivery. Each is bound by a written agreement that requires appropriate security and confidentiality.

A current list of subprocessors used to deliver client services is available on request.

Because EMPLOI operates between South Africa and the United States, personal information may be transferred across borders. We rely on Standard Contractual Clauses, POPIA Section 72 safeguards, and equivalent contractual protections to ensure a comparable level of protection wherever data is processed.

We keep personal information only for as long as needed to deliver our services and to meet our legal obligations. Employment, payroll, and tax records are retained for the periods required by South African and US law. Marketing and website analytics data is retained for shorter periods and reviewed regularly.

If you are a resident of California or another US state with a comprehensive privacy law, you have specific rights over your personal information. This section describes those rights and how to exercise them.

California CPRA rights include:

• Right to know - request the categories and specific pieces of personal information we have collected about you, the sources of that information, and the business or commercial purpose for collecting it.
• Right to delete - request that we delete personal information we have collected from you, subject to exceptions required by law such as payroll, tax, and employment records.
• Right to correct - request correction of inaccurate personal information we hold about you.
• Right to opt out of sharing - request that we stop "sharing" your personal information for cross-context behavioral advertising, if applicable.

Do we sell or share personal information? EMPLOI does not sell personal information. We do not share personal information for cross-context behavioral advertising as defined by the CPRA. We use a limited set of analytics and advertising cookies for site measurement only, and we do not disclose personal information to ad networks for behavioral targeting.

How to exercise your rights - email privacy@emploieor.com with the subject line "US Privacy Rights Request." We will verify your identity and respond within the timeframe required by applicable law, typically 45 days for California requests with one 45-day extension if reasonably necessary.

Authorized agents - you may designate an authorized agent to make a request on your behalf. We may ask the agent to provide signed permission and proof of identity, and we may contact you directly to confirm the request.

Non-discrimination - we will not discriminate against you for exercising any of these rights.

Residents of Virginia, Colorado, Connecticut, Utah, and other states with comprehensive privacy laws may have similar rights. Send your request to privacy@emploieor.com and we will handle it in accordance with the law that applies to you.

Depending on where you live, you may have the right to access, correct, delete, or port your personal information, to object to certain processing, or to lodge a complaint with a supervisory authority (in South Africa, the Information Regulator).

We use encryption in transit, access controls, least-privilege permissions, and regular reviews to protect the information we hold. No system is perfectly secure, but we work continuously to reduce risk and to notify affected parties promptly if anything goes wrong.

We may update this policy from time to time. Material changes will be communicated via the website or by email where appropriate. The date at the top of this page reflects the latest revision.
